An application under Order VI Rule 17 of the Code of Civil Procedure. 1908
The humble petition of the above named plaintiff most respectfully states as follows:
Sheweth:
1. That the plaintiff has filed the above Title Suit in this Court which is pending for hearing.
2. That the defendant in his written statement has raised various objections challenging the maintainability of the plaintiff’s suit.
3. That in order to meet the said objections the plaintiff above-named filed this petition for the amendment of the plaint as set out in the schedule to this petition.
4. That the proposed amendment does not in any way change the nature and character of the suit and is only formal in nature in order to meet the objections of the defendant made in the written statement.
Under this circumstances it is therefore prayed that your honour would be pleased to allow the amendment of prayed for the end of justice.
